Terms of Service

Last updated: 28 September 2026, effective 28 September 2026. These terms are an agreement between you and SUPEREZ PTY LTD (ABN 17 663 697 318), trading as Meritly. By creating an account or using Meritly you agree to them. Our Privacy Policy and Refund & Cancellation Policy form part of these terms.

1. Accounts and who may hold them

  • Free practice needs no account. It is meant to be set up by a parent or guardian, who agrees to these terms by using it.
  • Accounts are held by a parent or guardian aged 18 or over. Students use Meritly through profiles you create inside your account — a student profile is not a separate contract with the child, and children cannot register directly.
  • You are responsible for the accuracy of your account information, for keeping credentials (including the family code) within your household, and for activity under your account and its student profiles.
  • One account serves one family or household. Student profile limits for family plans are shown at the time of purchase.

2. What Meritly is — and is not

  • Meritly provides practice questions and practice papers generated from our own question bank, with automatic marking and worked solutions.
  • Free practice covers Years 1 to 10. It draws from a limited set of questions, so some will repeat, and nothing is saved between sessions. It has a daily limit, and some of the pages around it show ads.
  • Practice papers described by reference to NAPLAN, ICAS or the AMC are built by us to the published specifications of those tests. Meritly is not affiliated with, endorsed by, or connected to the organisations that write or run the tests we cover, and we do not reproduce their test content.
  • Our descriptions of NAPLAN, ICAS, the AMC and other tests — such as their format, timing and content — are based on our own analysis, not official documents, and the official information published by each test's provider always prevails.
  • Any level, band or estimate we show (for example an indicative proficiency level) is our estimate for practice purposes only. It is not an official result and does not predict one.
  • Which practice papers are available changes over time: papers can appear — and occasionally pause.
  • Meritly supports learning; it is not a school, a tutor, or a guarantee of any academic outcome.

3. Subscriptions and trials

  • Prices are in Australian dollars. Current pricing is always on the pricing page and at checkout.
  • Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account. Cancellation takes effect at the end of the period you have paid for, and you keep access until then.
  • Free trials require a payment method. Nothing is charged during the trial, we email you a reminder at least three days before the first charge, and cancelling during the trial means you are never charged.
  • A first subscription starts with one free trial of seven days. A valid offer code issued before 28 September 2026 gives a 30-day trial instead, if it is used by 21 December 2026. Free trials are limited to one per family account, and a trial that has started runs its full length.
  • A subscription has no limit on how much each child practises. To protect the question bank, the number of new questions each child can see in each calendar month (Sydney time) is capped. Once a child reaches the cap, practice continues with questions they have already seen. If a subject or a mock paper can't be put together from those questions, it opens again the next month.
  • Question packs are no longer sold. If you bought one before 28 September 2026, its remaining credits stay on your account and don't expire. Each credit still covers one question.
  • Work your child has completed remains viewable in your account — including worked solutions where they were unlocked — even after a subscription ends.
  • If we change a price, we will give you at least 30 days' notice by email before it affects you, and you can cancel before the new price applies.

4. Fair use

Meritly is for your household's personal, non-commercial use. Because the value of the service is the question bank itself, you must not:

  • copy, scrape, harvest, or systematically download questions, solutions, or reading texts, whether manually or with automated tools;
  • republish, resell, or redistribute our content, or use it to build or train a competing product or an AI model;
  • share account access outside your household, or circumvent limits, metering, or access controls.

We may suspend or limit an account being used in these ways. Where it is reasonable to do so, we will contact you first.

5. Intellectual property

All Meritly content — questions, solutions, reading texts, software and design — is owned by or licensed to SUPEREZ PTY LTD. We grant you a personal, non-transferable licence to use it through the service while you have an account. If you send us feedback or suggestions, we may use them without obligation.

6. Availability and changes

We aim to keep Meritly available and improving. We may change or retire features. If we materially reduce what a paid subscription includes, we will tell you in advance and you may cancel with effect from the change. Planned maintenance and occasional faults can interrupt the service — where an interruption is significant, your remedies under the Australian Consumer Law and our Refund Policy apply.

7. Your consumer rights, and the limits of ours

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that we cannot lawfully limit.

Subject to that paragraph: Meritly is provided "as is"; we are not liable for indirect or consequential loss; and our total liability in connection with the service is limited, at our choice, to re-supplying the service or the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in this section applies to liability that cannot lawfully be limited.

8. Ending the agreement

You can close your account at any time. We can suspend or terminate an account for a serious or persistent breach of these terms; where reasonable, we will warn you first. On closure, data is handled as described in the Privacy Policy, and any unexpired subscription period is dealt with under the Refund & Cancellation Policy.

9. Assignment

We may assign or novate this agreement to a related body corporate or in connection with a sale, transfer, or restructure of the business. If that happens, we will notify you, your terms will not become less favourable as a result of the transfer itself, and continuing to use Meritly after notice constitutes acceptance. You may not assign your account.

10. Changes to these terms and governing law

If we change these terms in a way that matters, we post the updated terms on this page with the date they take effect. We also show a notice on the parent sign-in page and in your account. A change can take effect on the day it is posted. Continuing to use Meritly after the effective date means you accept the updated terms. If you don't accept them, you may stop using Meritly and cancel any subscription under clause 3. Price changes, and changes that materially reduce what a paid subscription includes, still get the advance notice set out in clauses 3 and 6.

These terms are governed by the laws of the State or Territory in which SUPEREZ PTY LTD has its registered office, and the laws of the Commonwealth of Australia. Questions about these terms: hello@meritly.com.au.
